1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Axess ("we," "us" or "our"), concerning your access to and use of the Axess website and services as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
2. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
3. User Representations
By using the Site, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete.
- You will maintain the accuracy of such information and promptly update such registration information as necessary.
- You have the legal capacity and you agree to comply with these Terms and Conditions.
- You will not use the Site for any illegal or unauthorized purpose.
4. Products and Purchases
We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products.
Lifetime Dashboard Access
By purchasing an Axess NFC card, you receive lifetime dashboard access to the standard profile editing and card-management features included with that card for the physical lifetime of the card, while Axess continues to operate the service and your account remains in good standing. This does not mean every future premium, enterprise, analytics, custom branding, integration, or third-party feature will be free. We may add, modify, remove, or charge separately for optional features to improve the platform, comply with law, or keep the service sustainable.
5. Payment Terms
Prices are shown in Philippine pesos unless stated otherwise. An order is not confirmed until we accept it and provide the applicable payment instructions or confirmation. You are responsible for providing accurate contact, delivery, and payment details. If payment is not completed, is reversed, or cannot be verified, we may pause production, delivery, dashboard access, or fulfillment until the issue is resolved.
6. Shipping, Pickup, and Delivery
Shipping and pickup timelines are estimates, not guarantees. Delivery time may vary based on production volume, courier availability, destination, holidays, weather, address accuracy, and events outside our control. If your order requires delivery, you are responsible for providing a complete and reachable delivery address and phone number. We will help coordinate reasonable delivery issues, but we are not responsible for delays caused by incorrect details or courier-side disruptions after handoff.
7. Cancellations, Refunds, and Replacements
You may request cancellation before production begins. Because Axess cards may be personalized, printed, linked, or prepared for a specific customer, completed or in-production orders are generally not refundable unless the card is defective, damaged on arrival, or materially different from what you ordered. If there is a problem with your order, contact us within seven days after receiving it so we can review the issue and, where appropriate, repair, replace, or refund the affected item.
8. Warranty and Card Compatibility
Axess cards are designed to work with compatible NFC-enabled iPhone and Android devices, but performance can vary based on device model, settings, phone case, browser, network connection, and how the card is tapped. We do not guarantee compatibility with every device or future operating system change. Manufacturing defects reported within a reasonable period may be eligible for repair or replacement; loss, misuse, accidental damage, and normal wear are not covered.
9. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of the Site, you agree not to:
- Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
- Use the Site to advertise or offer to sell goods and services without our permission.
- Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
10. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.
11. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable consumer protection rights you may have under applicable law.
